DOWNTOWN SAN DIEGO — A $120,000 civil fine has been levied against the owners of a Pacific Beach property where marijuana dispensaries have been operating.
San Diego County Superior Court Judge Ronald Prager on Friday ordered the Nobel Family Trust and the Abeles Family Trust to pay the civil penalty for violating city zoning laws.
The action comes after city officials in 2011 ordered the Green Earth Herbal Collective operating at 936 Garnet Ave., to shut down. It did and settled with the city, but the property owners continued to contest the matter and a new dispensary opened at the site.
At a summary judgment hearing, Prager issued a permanent injunction against the defendants that prohibits them from operating a dispensary anywhere within the city limits.
“Property owners as well as dispensary operators need to know that they will be held accountable for violating our zoning laws,” City Attorney Jan Goldsmith said in a prepared statement. “The City Attorney’s Office will be continuing to shut down dispensaries operating illegally.”
Jeff Lake, attorney for the property owners, was unavailable and did not respond to a telephone call seeking comment.
The city in March filed a similar injunction against the Nobel and Abeles trusts for leasing to four dispensaries in different suites at 3045 Rosecrans. It has obtained temporary restraining orders and preliminary injunctions or default judgments against the property owners and all those dispensaries.
One of the dispensaries that was at the Rosecrans site, Greenworks SD, subsequently moved to an Engineer Road location in the city, where the dispensary caught fire as a result of hash oil extraction in July.
The city said the Nobels have agreed to issue eviction notices to dispensaries at other properties they own on University and Garnett avenues, La Jolla Boulevard and Turquoise Street. Dispensaries at those sites are contesting those notices.
