HOLYOKE — The City Council voted unanimously to adopt an ordinance to regulate recreational marijuana retail locations on Tuesday at City Hall.
The ordinance — which must be signed by Mayor Alex B. Morse in order to become effective — would restrict recreational marijuana retailers to general industrial zones in the city.
The ordinance covers recreational marijuana manufacturers, testers and dispensaries. (see below)
Operations including deliveries at such facilities would be prohibited between 8 p.m. and 8 a.m.
The vote came despite City Solicitor Paul Payer having advised that it would be a violation of state law because the Planning Board has yet to weigh in with a recommendation on the proposal.
City Council President Kevin A. Jourdain said the Council has for decades held a different interpretation of the law that means it was unnecessary to have a Planning Board recommendation before the Council could take action.
