LAKE HAMILTON – One of Polk County’s smallest municipalities could be going against the grain when it comes to medical marijuana.
The Town Council is set to become the first to vote to ban medical marijuana dispensaries in the municipal limits. Since it is an ordinance, it will require two readings with the first to come tonight.
“We had a moratorium on it and our chief of police had been looking at what other cities had been doing and made a presentation to the Planning Commission,” Town Administrator Sara Irvine said. “Our council recognized that we don’t have a pharmacy in the town and decided to ban at this time.”
According to state law, medical marijuana dispensaries must be treated nearly the same as pharmacies if allowed within city limits, but each municipal governing board is given the option to ban dispensaries. There are certain provisions pertaining to surveillance, distance from schools and hours of operations that apply to dispensaries and not to pharmacies.
